PEP Statements

PEP (Politically Exposed Person) refers to individuals holding prominent political positions as defined by the Act of March 1, 2018, on the prevention of money laundering and terrorist financing. The Act also includes definitions of individuals closely associated with PEPs and the definition of family members of PEPs.

According to Article 2, section 2, point 11 of the Act of March 1, 2018, on the prevention of money laundering and terrorist financing, a PERSON HOLDING A PROMINENT PUBLIC POSITION (excluding mid- and lower-level positions) refers to individuals holding significant public offices or functions, including:
a) Heads of state, heads of government, ministers, deputy ministers, state secretaries, undersecretaries of state,
b) Members of parliament or similar legislative bodies,
c) Members of political party governing bodies,
d) Members of the supreme courts, constitutional tribunals, and other high-level judicial bodies whose decisions cannot be appealed, except in extraordinary procedures,
e) Members of audit courts or central bank governing bodies,
f) Ambassadors, chargés d'affaires, and senior military officers,
g) Members of administrative, managerial, or supervisory bodies of state-owned enterprises, companies with state ownership where more than half of the shares or stakes are owned by the state or other state legal entities,
h) Directors, deputy directors, and members of governing bodies of international organizations or individuals performing equivalent functions in these organizations,
i) General directors in central and regional government offices,
j) Other individuals holding public positions or performing public functions in state bodies or central government administration bodies.

A FAMILY MEMBER OF A PEP (Politically Exposed Person) is defined in Article 2, section 2, point 3 of the Act of March 1, 2018, as:
a) The spouse or person living in a domestic partnership with a PEP,
b) The child of a PEP and their spouse or partner,
c) The parents of a PEP.

CLOSE ASSOCIATES OF A PEP (Politically Exposed Person), according to Article 2, section 2, point 12 of the Act of March 1, 2018, are:
a) Individuals who are the beneficial owners of legal entities, unincorporated organizations, or trusts, in cooperation with the PEP or maintaining close business-related relationships with the PEP,
b) Individuals who are the sole beneficial owners of legal entities, unincorporated organizations, or trusts known to have been created to gain real benefits for a PEP.

The current list of persons classified as PEPs is provided by the Regulation of the Minister of Finance, Funds, and Regional Policy of July 27, 2021, on the list of national positions and public functions classified as politically exposed positions.
